DUI 4th

If you are charged with a DUI within 5 years of receiving a DUI 3rd offense, you will be charged with a DUI 4th offense. A DUI 4th offense is a Class D felony in KY.

If you are convicted of a DUI 4th offense in KY you are subject to fines and jail time.  You will also become a felon. Fines and court costs may apply.


If you are convicted of a DUI 4th offense you have an automatic jail sentence of  120 day imprisonment without probation. If you are convicted of an aggravating circumstance you will receive an automatic jail sentence of 240 days. You cannot get probation.


The Court may require you to serve from 10 days to 12 months of community service.


If convicted of a DUI 4th offense in Ky you will receive a 60 month (5 years) license suspension.  You might also be required to install an ignition interlock device in your vehicle.  Before reinstating your license the KY Transportation Department requires that you file an SR22 form showing proof of an SR22 insurance policy to prove financial responsibility.


If convicted of a DUI 4th offense you will have to undergo an alcohol/ drug assessment and a subsequent one year treatment program.  The treatment program must be approved by the Court.  The Court Clerk has a list of approved treatment programs.  You are responsible for the costs associated with the assessment and treatment program.  If you must attend an out-of-state treatment program you must make sure the program is approved by the Cabinet for Human Resources. Your license cannot be reinstated until the treatment program is completed, even if your suspension period has expired.
