DUI 3rd

If you are charged with a DUI within 5 years of receiving a DUI 2nd offense, you will be charged with a DUI 3rd offense.  With each DUI conviction, your punishment becomes worse.

If you are convicted of a DUI 3rd offense in KY you are subject to fines and jail time.

FINES:

If you are convicted of a DUI 3rd offense you are subject to fines between $500 and $1000.  You will also be assessed a mandatory DUI Service Fee of $350.  You are also responsible for court costs and fees that the court may assess.  The court almost always assesses court fees.

JAIL TIME:

If convicted of DUI 3rd you will be jailed for a minimum of 3o days up to a maximum of 12 months in jail.  If you have an aggravating circumstance you must serve a minimum of 60 days in jail.

COMMUNITY SERVICE:

If convicted of DUI 3rd the Court may sentence you to 10 days of community service up to 12 months of community service.

LICENSE SUSPENSION:

If convicted of DUI 3rd offense your license will be suspended for at least 24 months and maybe up to 36 months.

ALCOHOL/DRUG ASSESSMENT AND TREATMENT:

If convicted of DUI 3rd offense you will be required to submit to alcohol/drug assessment and a one year treatment program. The treatment program must be approved by the District Court.  The District Court Clerk has a list of approved treatment programs.  You are responsible for the costs associated with the assessment and treatment program.  If you must attend an out-of-state treatment program you must make sure the program is approved by the Cabinet for Human Resources. Your license cannot be reinstated until the treatment program is completed, even if your suspension period has expired.
