Can I be found guilty of DUI if my medication was prescribed to me by a Dr?

One of the frequent questions I hear is “Can I be found guilt of a DUI in KY if I am taking prescription medication?”  The answer to that is “YES”.

You can be found guilty of DUI in Ky, even if you are taking medication that your doctor prescribed you. It does not matter whether or not you are taking the medication as prescribed by your doctor.  If your blood is positive for a controlled substance, or any substance, that might effect your ability to drive  a motor vehicle, you can be charged with a DUI and later be found guilty of the DUI. If the officer has reason to suspect that you are taking medication that might effect your ability to operate a car you can be charged with a DUI, even if you refuse to give a  blood sample. Many times this happens when pills are in the driver’s possession at the time of the arrest.

If you are charged with a DUI in Fayette (Lexington), Clark (Winchester), Madison (Richmond), Woodford (Versailles) or Jessamine (Nicholasville) or any other county surrounding Lexington, please feel free to give us a call!
