Can I be convicted of a DUI when I’m not driving the vehicle?

You can be convicted of a DUI in KY even when you are not actively driving the vehicle.  You can even get a DUI if you are sleeping off drugs or alcohol while in your car. You need to simply be in physical control of the vehicle to be guilty of DUI in KY.

For instance, if you are inside the vehicle sitting in the driver’s seat, but the keys are in the floor of the passenger’s side of the vehicle, you can be found guilty of DUI because you had immediate access to the keys which put you in physical control of the car. You can be in physical control of the car even if you are asleep in the car and not attempting to drive it. You will still get charged with a DUI because you have physical control of the vehicle.

If you are charged with a DUI in Fayette (Lexington), Clark (Winchester), Madison (Richmond), Woodford (Versailles) or Jessamine (Nicholasville) or any other county surrounding Lexington, please feel free to give us a call!
